Acceptance of These Terms

These Terms of Service ("Terms") govern your use of Pictura (the "Service"). By creating an account or using the Service, you agree to these Terms, our Acceptable Use Policy, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the Service.

You must be at least 13 years old (16 if you live in the European Union) to use the Service. If you are under the age of majority where you live, you need a parent or guardian's permission.

Independent Service and AI Model

Pictura is an independent service. It is not affiliated with, endorsed by or sponsored by OpenAI. ChatGPT is a trademark of OpenAI; it appears only in our domain name (chatgptpicture.com), and the Service does not use OpenAI models.

All of our tools generate and edit images with Google's Nano Banana image model (Gemini 2.5 Flash Image), which we access through the AI API provider Kie.ai:

• The text-to-image generator uses google/nano-banana.
• All other tools, which edit an image you upload, use google/nano-banana-edit.

Naming these providers does not mean that Google or Kie.ai endorses or sponsors the Service. If we change the model, we will update this section.

The Service

The Service offers these AI image tools:

• Text-to-image generator: create an image from a written description.
• Nano Banana photo editor: upload a photo and describe a change, such as a new background, season or color. You may not use it to change a person's face or identity, or to show a real person in an event that did not happen.
• E-commerce product photos: upload a photo of a product, and the AI places the product in a new scene.
• Old photo restoration: upload an old photo to repair and colorize it.
• Photo colorizer: upload a black-and-white photo to add color to it.
• AI hairstyle changer: upload a photo of yourself, or of someone who agreed, to preview a new hairstyle.
• AI headshots: upload a photo of yourself to get a professional headshot of you.

Every result is an AI-generated image. The Service does not offer face swapping, "nudify" tools, tools that combine several people into one image, or any feature for placing a real person into events that did not happen.

You must sign in to generate images. We may add, change or remove tools, models and features, and we may pause the Service for maintenance. We will try to give reasonable notice of significant changes.

Your Account

You can sign up with an email and password, or with Google or GitHub where available. You agree to:

• Give accurate information and keep it up to date.
• Keep your password secure. You are responsible for all activity under your account.
• Hold only one account, and not share or sell access to it.
• Tell us through a support ticket if you think someone has accessed your account without permission.

Pricing, Billing and Credits

• Plans: we offer monthly subscriptions, yearly subscriptions and one-time credit packs. The price, billing cycle and credits of every plan are shown on our Pricing page and at checkout, before you pay.
• Automatic renewal: monthly subscriptions renew automatically every month, and yearly subscriptions renew automatically every year, at the end of each billing period until you cancel. Each renewal is charged to your payment method at the price in effect for that renewal.
• Cancellation: you can cancel a subscription anytime in your account settings. Cancelling stops future renewals. Your access and your credits continue until the end of the period you have already paid for.
• Credit packs: credit packs are one-time purchases and do not renew. Credits from a credit pack are valid for 1 year.
• Credit expiry: subscription credits are granted for each billing period and expire at the end of that billing period. You can see the expiry date of your credits in Settings.
• Cost per image: one image costs 30 credits. The cost is shown on the Generate button before you start. New accounts do not include free credits.
• Failed or blocked generations: if a generation fails, or a generated image is blocked by our moderation, the credits are returned to your balance automatically.
• No cash value: credits have no cash value, cannot be exchanged for money, and cannot be transferred, sold or shared with another account.
• Payment processing: payments are processed by our merchant of record, Waffo Pancake, or by the other payment processors shown at checkout (such as Stripe, Creem or PayPal). The merchant of record may appear as the seller on your card or bank statement. The processor's terms also apply to your payment.
• Price changes: we may change prices for future purchases and renewals. Changes never affect a period you have already paid for.
• Refunds: refunds are handled under our Refund Policy, which explains when you can get a refund and how to ask for one. Cancelling a subscription does not refund the current period, except as described in the Refund Policy or required by law.

Acceptable Use

Your use of the Service must follow our Acceptable Use Policy (the "AUP"), which is part of these Terms. The AUP explains in detail what is not allowed, how we moderate content, how to report violations and how we enforce the rules. In summary, you must not create, edit, upload or share:

• Pornography or other sexual (NSFW) content, including content for adults.
• Violent or gory content, including content that promotes terrorism or self-harm.
• Hate speech that attacks people because of a protected characteristic.
• Child-unsafe content (CSAM), meaning any sexual or sexualized content involving minors. We report it to NCMEC and other relevant authorities.
• Deepfakes or impersonation, such as face swaps, "nudified" images, real people combined into intimate scenes, or real people shown saying or doing things they never said or did, whether or not they consent.
• Content that infringes copyright or trademarks, or uses a person's likeness without permission.
• Anything else that is illegal, or that harasses, threatens, bullies or defames anyone.

You also agree not to:

• Abuse or try to bypass credit limits, rate limits, payment checks or safety filters.
• Create multiple accounts to collect benefits, avoid limits or get around a suspension.
• Scrape, reverse engineer, overload or disrupt the Service, or access it by automated means we have not allowed.
• Resell the Service, or access to it, without our written permission.

Every prompt is screened before generation, and uploaded and generated images may also be screened by automated moderation, as described in the AUP. The underlying AI model applies its own safety filters as well. We may refuse, block or remove content that we believe breaks these Terms or the AUP.

Photos of People

Some tools work with photos of real people. You may only upload photos of yourself, or photos for which you have permission from everyone pictured, and you must confirm this when you upload. Uploading another person's photo without their consent is prohibited. The AI headshot tool is only for photos of yourself. Do not upload photos of a minor unless you are their parent or legal guardian, or you have the consent of their parent or guardian. Having permission never allows you to create deepfakes. See Section 2.4 of the Acceptable Use Policy.

Your Content and Ownership

• Your uploads: you keep all rights you have in the photos and prompts you submit.
• Your results: you own the images you generate, to the extent permitted by law and by the terms of the underlying model providers. In some countries AI-generated images may not be protected by copyright, and other users may generate similar images.
• License to us: you give us a limited, worldwide, non-exclusive, royalty-free license to host, process, copy, transmit and display your uploads and results only as needed to provide, secure and support the Service. This includes sending them to our AI and content moderation providers for processing. The license ends when you delete the content or your account, except for copies we must keep by law.
• No training: we do not use your uploads or results to train AI models.
• Your responsibility: you are responsible for what you upload and for how you use your results, and you confirm you have all the rights and consents needed.

AI Output Disclaimer

AI results are generated automatically and can be wrong or unexpected. In particular:

• Results may change details, such as faces, text, logos, product shapes or backgrounds.
• Colors added during photo restoration are the AI's interpretation, not a record of the original colors.
• AI headshots and product photos may not be exact likenesses of the real person or product.

Please review every result carefully before you rely on it or use it commercially (for example in product listings, ads or official documents). You are responsible for making sure your use is accurate, lawful and not misleading.

All results are AI-generated. Do not present them as real photographs of events or of other people, and disclose that they are AI-generated wherever the law, or the rules of the platform where you publish them, require it.

Our Intellectual Property

The Service, including its software, design and branding, belongs to us or our licensors. These Terms do not give you any rights in it, except the right to use the Service as described here.

Breach, Suspension and Termination

You can stop using the Service at any time. To delete your account, open a support ticket.

If you break these Terms or the AUP, if the law requires it, or to protect our users or the Service, we may:

• Block requests and remove content.
• Send you a warning.
• Block your account from generating images.
• Suspend or terminate your account.

For serious or repeated violations, any remaining credits are forfeited and not refunded, unless the law requires otherwise. We report child sexual abuse material to NCMEC and the relevant authorities. If you believe we acted in error, you can appeal by emailing the support email listed in the footer of every page or by opening a support ticket, as described in the AUP.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that the Service will be uninterrupted or error-free, that results will be accurate, or that results will meet your needs. The Service depends on third-party providers, and their outages or changes may affect it.

Limitation of Liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Some places do not allow certain of these limits. In that case, they apply only as far as the law allows, and nothing in these Terms limits rights you have as a consumer that cannot be waived.

Changes to These Terms

We may update these Terms from time to time. When we do, we will change the date at the top of this page. If the changes are significant, we will also tell you through the Service or by email. If you keep using the Service after the changes take effect, you accept the updated Terms.
