Acceptable Use Policy
What you may not create with our AI image tools, how we moderate content, how to report abuse and how we enforce the rules.
Last updated: 2026-10-22
Overview
Pictura ("we", "us", the "Service") wants AI image generation to be safe, lawful and respectful. This Acceptable Use Policy ("Policy") explains what you may not create, upload or share with the Service, how we moderate content, how to report violations and what happens when this Policy is broken. It is part of our Terms of Service and applies to everyone who uses the Service.
1. Scope
This Policy covers all content on the Service:
- Prompts: the text you type to describe an image.
- Uploaded images: photos you upload, such as product photos, old photos to restore, or a photo of yourself for a headshot.
- Generated images: every image the Service creates or edits for you, and how you use or share it.
The Service offers these tools: a text-to-image generator, a Nano Banana photo editor, e-commerce product photos, old photo restoration, a photo colorizer, an AI hairstyle changer and AI headshots. All of them generate and edit images with Google's Nano Banana image model (Gemini 2.5 Flash Image), accessed through the API provider Kie.ai. The text-to-image generator uses the model google/nano-banana, and the editing tools, which work on an image you upload, use google/nano-banana-edit.
2. Prohibited Content
You must not use the Service to create, edit, upload or share content in any of these six categories:
- Pornography and sexual content (NSFW): nudity, sexual acts, and sexually explicit or sexually suggestive images. The Service does not allow adult content of any kind, including for adult users.
- Violence and gore: graphic images of killing, injury, torture, blood or mutilation; images of self-harm or suicide; animal cruelty; and images that glorify, promote or threaten violence, terrorism or violent extremism.
- Hate speech: images, symbols or text that attack, demean or dehumanize people because of their race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, age or another protected characteristic, including hate symbols and extremist propaganda.
- Child-unsafe content (CSAM): any sexual or sexualized image of a minor (anyone under 18) or of a person who appears to be a minor, whether realistic, drawn or fictional, and any image that exploits, abuses or endangers children.
- Deepfakes and impersonation: images that put one real person's face or identity onto another real person (face swap), undress or sexualize a photo of a real person ("nudify"), combine real people into a kissing, hugging or other intimate scene, or show a real person saying or doing something they never said or did, or taking part in an event that never happened. This applies to celebrities, politicians and other public figures as well as private individuals, whether or not they consent. It also covers images made to impersonate a real person, brand or organization.
- Copyright and trademark infringement: images that copy or closely imitate characters, artwork, photos or designs you do not have the rights to, and images that use brand names, logos or trademarks without permission, such as counterfeit product photos or fake brand ads. Uploading images you do not have the right to use is also prohibited.
The sections below explain these rules in more detail.
2.1 Zero Tolerance
The following lead to immediate account termination and may be reported to the authorities:
- Child sexual abuse material (CSAM) or any sexual content involving minors. We report it to the National Center for Missing and Exploited Children (NCMEC) and other relevant authorities.
- Content that promotes or supports terrorism, violent extremism or mass violence.
- Technical instructions for making weapons of mass destruction (chemical, biological, radiological or nuclear).
- Content that incites genocide or hatred against an ethnic or other group.
- Deepfakes of real people, including face swaps, nudification, intimate scenes of real people, and fabricated statements or actions, whether or not the people involved consent.
2.2 Allowed Only With Care
Some content is not banned outright but must meet these conditions. Our filters may still block it.
- Mild, non-graphic action or conflict (for example a historical scene or a fantasy illustration) needs a clear creative, historical or educational context and must not contain gore.
- Political and news-related images must not be misleading, must not look like real news photos of events that did not happen, and must not place real people in scenes or events that did not happen.
- Product photos of regulated goods (such as medicines, supplements, cosmetics or alcohol) must show the real product honestly and follow the advertising rules where you sell it.
2.3 Other Prohibited Conduct
You also must not:
- Create or spread fake images presented as real news, real events or evidence, or any other misinformation.
- Create fake identity documents, receipts, certificates or other images meant for fraud.
- Use the Service for anything illegal, or to harass, threaten, bully or defame anyone.
- Present AI-generated images as real photographs of events or of real people, or as human-made work where that would mislead people.
- Use product photos to misrepresent the product itself, for example by showing features, quality or packaging the real product does not have.
- Bulk-generate spam or deceptive commercial content.
- Try to get around our safety measures, for example with jailbreak prompts, deliberate misspellings, coded words, splitting a request into parts, or using uploaded images to slip in content our prompt filters would block.
2.4 Photos of Real People
Some tools accept uploaded photos, and those photos may show real people.
- You may only upload photos of yourself, or photos for which you have explicit permission from every person shown. Uploading another person's photo without their consent is prohibited.
- Before you upload a photo, you must confirm that it is of yourself or that you have permission from everyone pictured.
- The AI headshot tool is only for photos of yourself. Do not upload anyone else's photo to it, even with their permission.
- Do not upload a photo of a minor unless you are their parent or legal guardian, or you have the consent of their parent or guardian.
- Permission from the people in a photo never allows you to create the deepfake content banned in Section 2.1.
The Service does not offer face swapping, "nudify" tools, tools that combine two or more people into one image, or any feature for placing a real person into an event that did not happen. Do not try to use any tool for these purposes.
2.5 Using AI-Generated Images Honestly
Every image the Service produces is generated or edited by AI.
- Do not present results as real photographs of events or of other people.
- Disclose that an image is AI-generated wherever the law, or the rules of the platform where you publish it (for example a marketplace, social network or ad platform), require it.
3. How We Moderate Content
We use several layers of checks. Automated checks run before and after generation, and a person reviews every report.
3.1 Prompt Checks
- Prohibited-terms blocklist: every prompt is checked against our list of prohibited terms related to the categories in Section 2. Our team maintains this list in our admin panel and updates it as new abuse patterns appear. Prompts that match are not generated.
- Waffo Prompt Sift: before generation, every text prompt is also screened by Waffo Prompt Sift, a content-safety service provided by Waffo. Prompts that it blocks, or holds for review, are not generated.
3.2 Image Checks
When our automated image moderation is enabled, an image moderation model screens:
- the photos you upload; and
- every generated image, before it is shown to you. If a generated image is flagged, it is not shown to you and the credits for it are refunded to your balance.
3.3 Model Provider Safety Filters
The underlying model provider (Google's model, accessed through Kie.ai) applies its own safety filters and may refuse requests or results that break its content rules.
3.4 Human Review and Records
- A person reviews every report and every appeal. Reports involving child safety are handled first.
- We log moderation decisions, including automated results and human review decisions, so that we can investigate abuse, handle appeals and show how we enforce this Policy.
Automated checks can make mistakes. If you think a prompt or image was blocked in error, see Section 6 (Appeals).
4. Reporting Violations
Anyone can report content made with the Service, whether or not they have an account.
4.1 What to Report
- Images made with the Service that break this Policy.
- Images that use your likeness without your consent, impersonate you, or infringe your copyright or trademark.
- Anything that may involve child sexual abuse or exploitation. Please report it right away.
4.2 How to Report
- Email: write to the support email listed in the footer of every page.
- Support ticket: if you have an account, sign in and open a ticket under Settings > Support Tickets (/settings/tickets).
Please include:
- Where you found the content (a link, a screenshot or a description) and when.
- Which rule you think it breaks.
- If the report is about your own image, likeness or work: information showing that you are that person or the rights holder, or that you are authorized to act for them.
- An email address where we can reach you.
If you suspect child sexual abuse material, do not send us copies of the image. Just describe where you found it, and also report it to the NCMEC CyberTipline or your local police.
4.3 How We Handle Reports
- We acknowledge your report, and a person reviews it, typically within 2 business days. Reports involving child safety are handled first.
- If we confirm a violation, we remove the content and take action under Section 5. Suspected child sexual abuse material is reported to NCMEC and the relevant authorities.
- We may contact you if we need more information.
We keep the reporter's identity confidential and do not share it with the reported user, unless the law requires us to. Every report is reviewed on its facts. False or malicious reports are recorded, and accounts that file reports in bad faith may face action.
5. Enforcement
Depending on how serious a violation is, whether it was deliberate and whether it has happened before, we may:
- Block the request: refuse to generate an image, or withhold the result.
- Remove content: delete violating images from the Service.
- Warn you: send a notice explaining the violation.
- Block generation: stop your account from generating images, temporarily or permanently.
- Suspend or terminate your account.
- Forfeit credits: for serious or repeated violations, any remaining credits are forfeited and not refunded, unless the law requires otherwise.
- Report to the authorities: we report child sexual abuse material to NCMEC and the relevant authorities, and we cooperate with law enforcement where the law requires.
As a general guide:
- A first, minor violation (for example a borderline prompt) usually leads to a blocked request and a warning.
- Repeated or serious violations lead to content removal, a generation block, or account suspension.
- Zero-tolerance violations (Section 2.1) lead to immediate account termination and forfeiture of any remaining credits, and where applicable a report to the authorities.
Creating a new account to get around a suspension is not allowed, and that account will also be closed.
6. Appeals
If you believe we took action against your content or account in error, you can appeal through the same channels: the support email listed in the footer of every page, or a support ticket. Tell us your account email, what action was taken and why you think it was wrong. A person reviews every appeal, where possible someone who was not involved in the original decision. If we find that we made a mistake, we will reverse the action.
7. Changes to This Policy
We may update this Policy as our tools, the law and abuse patterns change. When we do, we will change the date at the top of this page. If the changes are significant, we will also tell you through the Service or by email. If you keep using the Service after the changes take effect, you accept the updated Policy.
8. Contact
If you have questions about this Policy, email the support email listed in the footer of every page, or sign in and open a support ticket under Settings > Support Tickets (/settings/tickets).
